1. APPLICABILITY. These Supplemental Terms govern Dynamics 365 and Power Platform preview, beta, or other pre-release features or services for voice and text communications (“Communication Services Previews”).
2. MICROSOFT COMMUNICATION SERVICES PREVIEWS. Communication Services Previews are provided by Microsoft through the Microsoft Affiliate or other service provider authorized to administer them. Pricing for Communication Services Previews may include applicable taxes and fees. Communication Services Previews terms may vary from country to country. In addition to these Supplemental Terms, all included taxes, fees and terms for Communication Services Previews are disclosed in the terms of use available on the Volume Licensing site at https://go.microsoft.com/fwlink/?linkid=2217926. If an Online Service enables you to access voice and text communication features provided by third parties those services are provided under separate terms directly between you and the third party. Microsoft is not the provider of, and does not manage billing or support for, any such third party communication services.
3. MESSAGING ACTIVITIES. You acknowledge that with respect to your use of any messaging services, including any messaging features provided as part of the Communications Services Previews, you control and are responsible for, and Microsoft does not determine, the (a) message content sent to recipients, (b) selection of message recipients, (c) decision on whether or when to send such messages, (d) actual sending of the messages, or (e) obtaining or retaining any necessary consents to send such messages. Microsoft has no involvement in the foregoing actions, or your use of any messaging services, including any messaging services provided by Microsoft or third-parties.
4. COMPLIANCE WITH LAWS; NOTICE AND CONSENT FOR CALL RECORDING/TRANSCRIPTION. You must comply with all laws and regulations applicable to your use of the Communication Services Previews, including laws related to biometric data, confidentiality of communications, recording or monitoring of telephone calls, laws requiring consent of participants to receive calls or text messages, and data protection requirements. You are responsible for determining whether the Communication Services Previews are appropriate for storage and processing of information subject to any specific law or regulation and for using the Communication Services Previews in a manner consistent with your legal and regulatory obligations. If you use the Communication Services Previews to process biometric data, you are responsible for: (i) providing notice to data subjects, including with respect to retention periods and destruction; (ii) obtaining consent from data subjects; and (iii) deleting the biometric data, all as appropriate and required under applicable data protection requirements.
5. HIGH RISK AND REGULATED USES. Your use, or any use that you allow, of the Communication Services Previews in connection with certain activities may pose a high risk of causing death, bodily injury, or damage to property, including but not limited to use in connection with hospital or medical care services, emergency response or notification systems, other critical services or systems requiring high availability or reliability (such as control of modes of mass transportation or implantable medical equipment), and similar activities (collectively, “High Risk Use”). Other uses in connection with highly regulated activities, governmental, healthcare, financial services, and educational fields, may result in regulatory obligations for you or your authorized users (collectively, “Highly Regulated Use”). Certain uses, whether a High Risk or Highly Regulated Use or not, may require you or those that use the Communication Services Previews through you to disclose or limit the use of applications that simulate human conversation (such as chatbots). Microsoft Communication Services Previews were not designed for High Risk or Highly Regulated Uses or any activities requiring fail-safe performance. To the maximum extent permitted by applicable law, Microsoft disclaims any responsibility for any High Risk and Highly Regulated Use or non-compliant use of Communication Services Previews, and disclaims any express or implied warranty of fitness of Communication Services Previews for a High Risk or Highly Regulated Use or non-compliant use.
6. TERM AND TERMINATION RIGHTS. These Supplemental Terms terminate automatically and without notice with respect to any Communication Services Preview when it becomes generally publicly available, other than as a pre-release or “beta” product or service, or Microsoft ceases to offer the Preview. On termination or expiration of these Supplemental Terms, Participant must stop using the Communication Services Preview.
7. PREVIEW PHONE NUMBERS. You acknowledge that: (i) the telephone number(s) assigned to you as part of a Communication Services Preview are on a temporary basis and may not be eligible to be ported out of the Communication Services Preview, whether to the generally available version of the Communication Services or to another public switched telephone network (“PSTN”) carrier; (ii) pricing for Communication Services Previews, including the telephone number(s) associated with Communication Services Previews, are subject to change once the Previews become commercially, generally available.
8. NO ACCESS TO EMERGENCY SERVICES. Communication Services Previews do not support emergency voice and/or messaging access to Emergency Services. You will not seek to enable or attempt to use any of the Communication Services Previews to contact Emergency Services unless the specific Preview to which you have subscribed is expressly approved by Microsoft for Emergency Services. Neither Microsoft nor its representatives will be liable under any legal or equitable theory for any claim (including third-party claims), damage, or loss arising from or relating to the inability to use Communication Services Previews to contact Emergency Services.
