This page is provided for your convenience as an overview of the terms and conditions that govern use of Microsoft Sustainability Manager. Ancillary services, software, and content may be governed by additional or different terms not listed below.
Your use of the Sustainability Manager service is governed by the terms and conditions of the agreement under which you obtained the service.
• For customers who obtain a trial subscription to Sustainability Manager, your use is governed by the Microsoft Online Subscription Agreement (“MOSA”) (https://go.microsoft.com/fwlink/?linkid=2131104) and the Trial Supplemental Terms which include additional terms that apply to your use of the trial version of Sustainability Manager (“Trial Service”).
• For customers who purchase through another Commercial Licensing Program, such as an Enterprise Agreement, your use is governed by the licensing agreement under which you purchased the service. You can obtain a copy of your licensing agreement by contacting your Microsoft account representative or Commercial Licensing.

• Third Party Notices. Microsoft Sustainability Manager contains or interacts with third party materials described in this notice (https://go.microsoft.com/fwlink/?linkid=2190813).
• Fictitious Content. Demo data or other examples included in Sustainability Manager are for illustration purposes only and are fictitious. No real association is intended or inferred.
• Independent Validation Opinion from Apex. Microsoft commissioned Apex Companies, LLC to provide limited assurance of the U.S. Environmental Protection Agency’s factors and methodology used by Microsoft Sustainability Manager to help customers calculate their greenhouse gas emissions. • Microsoft Teams chats (preview). If Microsoft Teams chats (preview), a feature of Microsoft Teams collaboration and chat, is enabled by the tenant administrator, it is enabled for all applications that are built on Microsoft Power Apps and installed in the same environment, including Sustainability Manager. Use of this feature is subject to these preview supplemental terms of use (https://go.microsoft.com/fwlink/?linkid=2105274).
• Microsoft Emissions Impact Dashboard. Sustainability Manager interacts with the data output generated by the Emissions Impact Dashboard (https://go.microsoft.com/fwlink/?linkid=2195723), which contains emissions calculations based on IEA emissions factors and datasets from ecoinvent.
• Microsoft Cloud for Sustainability data model. To download or install the Microsoft Cloud for Sustainability data model stand alone, you must have a license to Microsoft Power Apps which is governed by the terms and conditions of the agreement for the Commercial Licensing Program under which you purchase or renew a subscription for the Power Apps service.
The Trial Service is made available pursuant to these additional terms, which supplement the MOSA.
1. Trial Period. Your organization may use up to 5 concurrent trial instances of the Trial Service (each, a “Trial Instance”) solely for testing and demonstration purposes. Each Trial Instance will be accessible starting on the date when the first user of a Trial Instance is first given access to it (“Trial Instance Effective Date”) and ending 30 days after the applicable Trial Instance Effective Date (each, a “Trial Period”). Before a Trial Period ends, you may renew a Trial Instance one time only for an additional 30 days. After the Trial Period for the applicable Trial Instance ends, that Trial Instance may be made available to you to export data in accordance with Section 4, after which that Trial Instance will be deleted. You may create a new Trial Instance in its place (subject to the foregoing limit on concurrent Trial Instances).
2. Termination. Microsoft may change or discontinue the Trial Service at any time without notice. In addition, Microsoft may terminate your access to any Trial Instance at any time if you fail to access and actively use that Trial Instance for any period of 7 consecutive days.
3. Administrator. Notwithstanding any provision to the contrary in the MOSA, as applicable to this Trial Service and solely to the extent there is not already an administrator associated with your organization, the administrator is deemed to be the first user in your organization who creates a Trial Instance. The administrator may be changed by anyone authorized to act on behalf of your organization who demonstrates administrative control over the domain associated with the email for that organization sufficient to manage the domain records.
4. Exporting Customer Data. If you include “live” or production Customer Data in any Trial Instance of this Trial Service, and you elect not to purchase a subscription to Sustainability Manager before expiration of the Trial Period for that Trial Instance, Microsoft: (A) has no obligation to return Customer data to you; (B) will retain such Customer Data for 7 days after the expiration of the applicable Trial Period for that Trial Instance; and (C) will, upon your request, make commercially reasonable efforts to work with you to export such Customer Data.
